1. About these terms

These terms govern the use of this website and the commissioned artwork services provided by Kriti Studio, the registered trade name of Rajat Pal, a proprietorship registered in India under GSTIN 09CVWPP3468C1ZX, with its principal place of business at 79, Unnamed Road, Near Pablikhas Railway Station, Modi Puram, Meerut, Meerut, Uttar Pradesh, 250110, India.

By commissioning work from us, you agree to these terms. Where a written quotation for a specific commission says something different, that quotation takes precedence.

2. What we provide

We produce original, hand-drawn artwork — principally graphite and charcoal portraits drawn from photographs supplied by you. Every commission is drawn by hand as a single original piece. We do not supply printed reproductions, digital renderings or machine-assisted drawings.

3. Reference photographs

By sending us a photograph, you confirm that:

• You own the photograph, or you have the photographer's permission to have it drawn
• You have the consent of any identifiable living person shown in it
• You accept that we may decline a reference that is not clear enough to work from

We may ask for a better photograph before beginning. Where you insist on proceeding with a reference we have advised against, we are not responsible for detail that could not be recovered from it.

4. Quotations, fees and payment

• Prices depend on paper size, medium, and the number of faces or subjects in the piece.
• Quotations are valid for thirty days.
• An advance of 50% confirms your place in the studio queue; drawing does not begin before it is received.
• The balance, along with framing and delivery charges, is payable before dispatch.
• All prices are exclusive of Goods and Services Tax, charged at the applicable rate.
• Framing, delivery and any express-timeline surcharge are quoted separately from the drawing fee.

5. Timelines

Hand-drawn work takes time, and the completion date we give you assumes the studio queue at the moment you confirm. Where you need a piece for a specific occasion, tell us the date before you pay the advance — we will either commit to it in writing or tell you it is not achievable.

We are not liable for missing an occasion where the commission was confirmed too close to that date, or where a delay was caused by you supplying a replacement reference photograph late.

6. Revisions and approval

We share progress photographs at key stages so that corrections can be raised while the drawing can still absorb them. Please raise them at that point.

Reasonable adjustments are included while a piece is in progress. Because this is pencil on paper, some changes cannot be made once a stage is complete — graphite and charcoal can only be lifted so many times before the paper surface is damaged. A change that requires the piece to be redrawn from the beginning is a new commission and is quoted as one.

7. Ownership and copyright

The physical artwork

Ownership of the physical drawing passes to you once payment has been received in full. It is yours to keep, display and gift.

Copyright

In line with normal practice for commissioned art, copyright in the drawing remains with the artist, Rajat Pal. Buying the artwork does not transfer the right to reproduce it commercially — for example on merchandise, packaging or for resale as prints. You are of course free to photograph your own piece and share it personally.

If you need commercial reproduction rights, tell us before commissioning and we will quote for them separately in writing.

Portfolio use

Unless you ask us in writing not to, we may photograph completed work and show it on this website, in our portfolio and on our social media channels. If a commission is a surprise gift, tell us and we will hold publication until after the date you specify.

8. Framing, packing and delivery

Pieces are sealed with fixative, packed rigid and dispatched with tracking. Risk in the artwork passes to you on delivery to the courier.

Please inspect the package on arrival. If a piece arrives damaged, tell us within 48 hours with photographs of both the artwork and the packaging as received — without those, a courier claim cannot be made. We will assist you in raising the claim, and will redraw a piece destroyed in transit at a fair cost to be agreed. Delivery timelines quoted by couriers are outside our control.

9. Cancellation and refunds

You may cancel before drawing begins for a full refund of the advance. Once drawing has begun the advance is not refundable, because a commissioned portrait of a specific person has no resale value to the studio.

Where a piece is more than half complete at the point of cancellation, the full commission fee remains payable and the artwork will be delivered to you.

We may decline or return a commission at our discretion — for instance where a reference photograph is unusable or its subject matter is one we are not willing to draw. In that case any advance is refunded in full.

10. Limitation of liability

We deliver our work with reasonable skill and care. To the fullest extent permitted by law, our total liability arising out of any commission is limited to the amount actually paid to us for that commission.

We are not liable for indirect or consequential loss, including disappointment or loss arising from a gift not arriving in time for an occasion; for limitations inherent in a reference photograph you supplied; or for the acts or delays of courier and framing vendors.

11. Use of this website

All artwork images, text and design on this website are the property of Kriti Studio and may not be copied, reproduced or used to train any automated or machine-learning system without our written permission.

12. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including illness or injury affecting the artist, natural disasters, power or internet outages, courier disruption, government restrictions or civil disruption.

13. Governing law and jurisdiction

These terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Meerut, Uttar Pradesh.

14. Changes to these terms

We may revise these terms from time to time. The version in force on the date a commission is confirmed governs that commission.
